Roches Beach Living is set in beautiful landscaped gardens in Lauderdale, Tasmania, with Mount Wellington as the picturesque backdrop. Roches Beach Living is just a short drive from the thriving communities of Bellerive and Rosny.
WHO MANAGES AND OWNS ROCHES BEACH LIVING?
Thriveliving Pty Ltd ACN 118 500 342 is the trustee of The Thrive Retirement Living Unit Trust ABN 90 664 215 268 (“Thriveliving”), the developer, owner, and manager of the retirement village called Roches Beach Living.
The major unitholders of Thrive Retirement Living Unit Trust include Dr. John Saul, a practicing local GP and his wife Kate, John Sikkema, developer and financial adviser, Frank Sikkema, developer and builder, and Michael Spinks, chartered accountant and financial adviser. Collectively, they are very experienced in business and financial management, building and maintenance, as well as medical and social support. This partnership of expertise ensures a strong management and service focus covering all the skills required for the retirement housing industry. Thriveliving is committed to long term quality accommodation.
Our Mission Statement is to provide safe, secure housing in an independent manner for all residents. Our goal is to assist in all aspects of social, medical and personal needs allowing residents to thrive while actively living.
Roches Beach Living is a new development, hence is not yet eligible (until completion), for assessment for the National Independent Accreditation Standards conducted by the Retirement Village Association of Australia. All aspects of the development are based on achieving these standards as well as complying with the Tasmanian Retirement Villages Act 2004. As soon as practicable, and upon completion, Roches Beach Living will apply for accreditation.
WHAT TYPE OF ACCOMMODATION AND FACILITIES ARE AVAILABLE?
Roches Beach Living, when completed, will have 53 2 or 3 bedroom townhouses, some with conjoined garages. Each townhouse is constructed to a high quality and includes modern kitchen and bathroom, laundry, dining and living area and lock-up garage. All surrounding garden and grassed areas are designed by a landscape architect to the highest of standards.
All townhouses come complete with carpets, blinds or curtains, light fittings, kitchen appliances such as cook top, oven, microwave and refrigerator as well as a reverse cycle heat pump. All other fixtures are outlined in further documentation.
Facilities available, when Roches Beach Living is completed, will include an extensive Community Centre, meeting room, lounge areas, widescreen TV and entertainment area, games areas (including slate top eight ball table and indoor bowls), library, rooms for visiting specialists, physiotherapists, podiatrists and nurses. Outdoors there will be a BBQ area, bowling green, community garden and walking paths. Recreational and social activities will also be organised from the Community Centre by the residents own Social Committee.
The extensive catering facilities in the Community Centre can be used for social activities.
The Community Centre is also available for use by residents for private functions.
WHEN CAN I APPLY FOR A TOWNHOUSE AT ROCHES BEACH LIVING?
Any person over the age of 55 and who are retired or nearing retirement can apply to live at Roches Beach Living. Yes, you are able to work, but your townhouse or any of the facilities are not to be a place of business.
WHAT COSTS ARE NOT INCLUDED AS PART OF MY LIFETIME TENANCY AGREEMENT?
In addition to the fees outlined in the section “What Fees do I Pay and How are they Calculated”, incoming residents need to be aware that they will be responsible for their own personal costs, including telephone connection, and rental and calls, internet connection and rental, light and power, moving costs and some maintenance and replacement costs.
Currently, there is no State Government stamp duty costs associated with acquiring a Lifetime Lease on a townhouse in a Retirement Village.
For your own assurance with the Lifetime Lease we recommend you discuss all details with your solicitor and/or financial advisor as well as any relevant family members to ensure that you understand the purchase details and make sure that all aspects of Roches Beach Living are right for you.
Roches Beach Living use the services of John Harrison and Anthony Laning at respected Hobart law firm Ogilvie Jennings. They, together with Michael Spinks of Business Advisory firm Collins SBA, are available for your advisors to discuss any legal or financial details of the Agreement.
HOW DO I APPLY FOR A TOWNHOUSE?
If you wish to reserve a townhouse exclusively for yourself, you will need to complete and sign the Expression of Interest to Lease a Townhouse document.
Upon signing this document, you will need to pay to Thriveliving a deposit of $1,000. Thriveliving will then prepare the following documents for your solicitor/advisor to peruse:
· Agreement for Lease – Townhouse, and
· Memorandum of Lease – Roches Beach Living.
Once you are happy with your choice of Townhouse, you will need to sign both agreements and pay a further deposit of $10,000 to secure your Townhouse. This deposit will be placed into the Ogilvie Jennings Solicitors Trust account (Thriveliving’s solicitor’s), and will be held in trust until settlement of your Townhouse.
If you are unable to proceed by reason of needing a higher level of care through illness, or in the case of death, your deposit will be refunded in full.
WHAT DO I OWN WHEN I PURCHASE A TOWNHOUSE AT ROCHES BEACH LIVING?
When you join Roches Beach Living as a resident, you will receive a Lifetime Lease over the title of Roches Beach Living registered at the Tasmanian Lands Titles Office.
CAN I MAKE ANY ALTERATIONS TO MY TOWNHOUSE?
To maintain the style and feel of your Townhouse and Roches Beach Living generally, any additions, alterations, or installations are not permitted without the written approval of the management of Roches Beach Living.
WHAT HAPPENS IN AN EMERGENCY OR IF I NEED MEDICAL TREATMENT?
Roches Beach Living has a 24 Hour Emergency Call System. This is a state of the art system which allows access to the on-site caretaker at the press of a button or the activation of a pendant alarm. The caretaker will assist as far as possible and if necessary call your doctor or an ambulance.
Any caretakers appointed by Roches Beach Living to live on site will have medical training and will be available to assist you with medical emergencies.
Consultancy suites will be available in the Community Centre for visiting medical professionals. Roches Beach Living has very strong links with local services. Doctors, physiotherapists, nurses and podiatrists are available, if required. Even an exercise consultant can be arranged, so all your medical needs can be catered for.
HOW SAFE AND SECURE WILL I BE?
The two entrances to Roches Beach Living will both be locked at night. Entry will only be possible through remote control or by our on-site caretaker. Each townhouse will have its own security alarm, smoke detection sensors and emergency pendant, which are all monitored internally and externally.
Roches Beach Living will also provide security for the overall site, including the Community Centre.
CAN I BRING MY PETS?
At Roches Beach Living we welcome your pets, however, as they must live in harmony with other residents, written permission must first be obtained from management.
For larger pets such as dogs, fencing can be arranged through Roches Beach Living but the cost is to be borne by the resident. Further guidelines on other pet issues such as noise control are available on request.
CAN FRIENDS OR FAMILY COME TO STAY?
Most certainly. We encourage you to maintain strong links to family and friends. For security reasons, you will need to inform management when you have guests to stay.
Your guests are also welcome to use the facilities at Roches Beach Living, as long as a resident accompanies them.
To maintain the style and ambiance of Roches Beach Living, any long-term visitors need to be notified and agreed to by Roches Beach Living management. You cannot sub-lease or rent your townhouse to a third party.
WHAT IF I GO ON HOLIDAYS OR TRAVEL?
No problem. We will forward your mail to you if requested or store it for your return. Monthly service fees (refer to the section headed “What Fees do I pay and how are they Calculated”) will continue during these periods of absence.
WHAT IF I NEED TRANSPORT?
Roches Beach Living is a short drive or walk to most facilities, including bakery, butcher and supermarket.
The public bus service is available a few minutes away on the South Arm Road or at nearby Bangalee Street. Roches Beach Living provides a twice weekly Maxi Taxi service to residents at a very modest cost.
WHAT HAPPENS WHEN I LEAVE ROCHES BEACH LIVING?
If you wish to leave for any reason, your Lifetime Lease will be terminated and a new resident will be found to re-lease your townhouse. You will receive the re-sale price of your townhouse less any applicable fees (please refer to the section headed “What Fees do I Pay and How are they Calculated”).
WHAT FEES DO I PAY AND HOW ARE THEY CALCULATED?
At Roches Beach Living we have a structure that is used at other Australian Accredited Retirement Villages and which complies with the Tasmanian Retirement Villages Act 2004.
There are three broad categories of fees:
· Monthly Service Fee (referred to in your agreement as Contribution to Outgoings);
· Annual Facility Fee and an annual contribution to Capital Improvement Reserve; and
· One off fees associated with selling your townhouse – these include a Marketing Fee and the
actual costs of refurbishing your townhouse (including a small Roches Beach Living management fee).
These fees are explained below:
MONTHLY SERVICE FEE (Contribution to Outgoings)
This fee (referred to in your agreement as ‘Contributions to Outgoings’) covers the general operation and maintenance of Roches Beach Living. These include costs in respect of all the common facilities and common equipment as well as their repair and replacement.
Some of the items covered in the Monthly Service Fee include:
· Insurance of buildings (Contents Insurance is the responsibility of the resident);
· Council rates and taxes and water charges;
· Staff salaries and on-costs including workers compensation;
· All costs associated with gardening, landscaping and common building maintenance;
· Costs of community facilities including BBQ area, recreational areas and bowling green (when installed);
· Maintenance of roads, paths, walking tracks and street lighting;
· Individual external building repairs and maintenance, including painting and window repairs;
· 24 Hour Security and Emergency Services;
Currently, the Monthly Service Fee is $520 per month for a couple or $346 per month for a single resident.
The Monthly Service Fee is required to be paid by the resident on a monthly basis and covers the estimated monthly outgoings incurred by Roches Beach Living.
ANNUAL FACILITY FEE & CONTRIBUTION TO CAPITAL IMPROVEMENT RESERVE
The Annual Facility Fee and the Annual Contribution to Capital Improvement Reserve Fee, are based upon the resale price of your townhouse. These fees are paid to Thriveliving only when you leave your townhouse and provide a financial incentive for Thriveliving to ensure that Roches Beach Living is well managed for the enjoyment of current residents, as well as improving the overall value of each townhouse.
The fees are calculated on the resale price of your townhouse as follows:
Facility Fee 3% per annum (capped at 30%)
Capital Improvement
Reserve 0.5% per annum
The Annual Facility Fee and the Annual Contribution to Capital Improvement Reserve are paid to Thriveliving upon leaving your townhouse.
ONE OFF SELLING FEES UPON LEAVING ROCHES BEACH LIVING
When you decide to leave Roches Beach Living, Thriveliving will need to find a suitable purchaser for your townhouse lease. To ensure you receive the maximum possible price for your townhouse, we will need to refurbish and market your townhouse. The fees associated with this are ‘one-off’ and are calculated as follows:
Marketing Fee
(Selling costs) 3% of the sale price
Refurbishment costs Actual costs of refurbishment plus small Management Fee for arranging the refurbishments
The Marketing Fee and the costs associated with refurbishing your townhouse are deducted from the re-sale price of your townhouse.
This structure has significant advantages as you share in the capital growth of your townhouse lease. We strongly advise you discuss the details with your advisor and/or family members.

Thriveliving reserves the right to change and amend this document at any time and does not warrant that it will be current at the time a resident enters into agreements with Thriveliving. This document is always subject to the terms and conditions in an agreement to lease and/or a Lifetime Lease entered into with Thriveliving.
